THIS IS AN IMPORTANT AND BINDING LEGAL DOCUMENT - By accessing, viewing, visiting, using, or interacting with this WEB SITE or with any content, advertising, or hyperlink on it, you are agreeing to all the provisions of this Terms of Use policy, including the Copyright notice, the Privacy Policy of this WEB SITE, and the Purchase Agreement of this WEB SITE. This Agreement is made by and between the MBD INVESTMENT GROUP, INC., an Illinois corporation, and you, the visitor or user of this WEB SITE (each being referred to individually as a "Party" and collectively as the "Parties"), by which MBD INVESTMENT GROUP, INC. agrees to allow you access to its WEB SITE at http://www.gratefulgrebe.com (the "WEB SITE") and the content of the WEB SITE, and you agree to access the WEB SITE and its content, subject to all of the terms and conditions of this Agreement.
Unless you have entered into an express written contract
with MBD INVESTMENT GROUP, INC. to the contrary, and as a condition of your use

content of the WEB SITE. However, you may save, print, and copy the content of
the WEB SITE for your own personal use; provided, however, that this permission

condition of viewing and you acknowledge that any unauthorized use is unlawful
and may subject you to civil or criminal penalties.

5.1. MBD INVESTMENT GROUP, INC. DISCLAIMS ANY RESPONSIBILITY FOR THE COMPLETENESS, ACCURACY,

INVESTMENT GROUP, INC. DISCLAIMS ALL
WARRANTIES OF NON-INFRINGEMENT OF ANY THIRD-PARTY RIGHTS, AND DISCLAIMS ALL
IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. VISITOR SHALL BE SOLELY
RESPONSIBLE FOR THE SELECTION, USE, AND SUITABILITY OF THE CONTENT, SERVICES,
INFORMATION, AND PRODUCTS AND MBD INVESTMENT GROUP, INC. SHALL HAVE NO LIABILITY THEREFORE. 5.3. MBD INVESTMENT GROUP, INC. DISCLAIMS, TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL WARRANTIES, REPRESENTATIONS OR OTHER ENDORSEMENTS, EXPRESS OR IMPLIED, WITH REGARD TO THE INFORMATION ACCESSED FROM, OR THROUGH, THE WEB SITE, THE SYSTEMS THAT PROVIDE IT, AND THE INTERNET, INCLUDING ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE, OR NON-INFRINGEMENT OF ANY THIRD-PARTY RIGHTS.
MBD INVESTMENT GROUP, INC. assumes no responsibility for damage to computers or software of the Visitor or any person with whom the Visitor subsequently communicates from corrupting code or data that is inadvertently passed to the Visitor's computer. Again, Visitor views and interacts with the WEB SITE and its contents at his, her, or its own risk.
Any information you download from the WEB SITE is at your
own risk. Although precautions are taken to prevent data corruption, MBD
INVESTMENT GROUP, INC. makes no warranty that
downloads are or will be free of corrupting computer codes, including, but not
limited to, viruses and worms.
By viewing, using, or interacting in any manner with the WEB SITE, including banners, advertising, pop-ups, or downloads, and as a condition of the WEB SITE to allow his, her, or its lawful viewing, Visitor forever waives all right to claims of damage of any and all description based on any causal factor resulting in any possible harm, no matter how heinous or extensive, whether physical or emotional, foreseeable or unforeseeable, under any theory of liability, whether in contract or tort or otherwise, whether personal or business in nature.
You agree to defend, indemnify, and hold harmless MBD INVESTMENT GROUP, INC. and the parents, subsidiaries, employees, and agents of MBD INVESTMENT GROUP, INC. against any losses, claims, damages, liabilities, penalties, actions, proceedings or judgments (collectively, "Losses") to which an Indemnified Party may become subject and which Losses arise out of, or relate to this Agreement or your access to and use of the WEB SITE and to reimburse an Indemnified Party for all legal and other expenses, including reasonable attorneys' fees incurred by such Indemnified Party in connection with investigating, defending, or settling any Loss whether or not in connection with pending or threatened litigation in which such Indemnified Party is a party.
No additional notice of any kind for any reason is due Visitor and Visitor expressly agrees that all rights to notice are waived as a condition for permission to view or interact with the WEB SITE.
For all purposes, this Agreement shall be deemed to have been entered by the parties in Cook County, Illinois, United States of America.
If any matter concerning this Agreement shall be brought before a court, pre- or post-arbitration, you agree that the sole and proper jurisdiction and venue shall be in Cook County, Illinois. In the event that litigation is in a federal court, the proper court shall be the United States District Court for the Northern District of Illinois.
For all purposes, this Agreement shall be deemed to have been made within the State of Illinois. This Agreement shall be governed by the laws of the United States of America and the laws of the State of Illinois, without regard to Illinois' choice of law and conflicts of law rules, and MBD INVESTMENT GROUP, INC. and Visitor each submit to the exclusive jurisdiction of the courts of Cook County, Illinois, or to the United States District for the Northern District of Illinois, should any claim or question arise under Federal law or federal jurisdiction based upon diversity of citizenship.
MBD INVESTMENT GROUP, INC. shall not be liable or deemed to be in default for any delay or failure in performance under this Agreement or interruption of service resulting directly or indirectly from acts of God, civil or military authority, acts of public enemy, war, terrorism, riots, civil disturbances, insurrections, accidents, fire, explosions, earthquakes, floods, the elements, strikes, labor disputes, shortages of suitable parts, materials, labor or transportation, magnetic interference, interruptions of electrical power or other utility service, unavailability of any telecommunications or wireless service or connection to any telecommunications or wireless service, or any cause beyond the reasonable control of MBD INVESTMENT GROUP, INC.
In the event that any portion of this Agreement is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties hereto, and the remainder of the provisions shall remain in full force and effect.
Any cause of action you may have with respect to MBD INVESTMENT GROUP, INC.'s performance or alleged non-performance of this Agreement must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is forever barred.
MANY OF THE LINKS ON THE WEB SITE WILL LET YOU LEAVE THE WEB SITE. THE
LINKED SITES ARE NOT UNDER THE CONTROL OF MBD INVESTMENT GROUP, INC., AND MBD
INVESTMENT GROUP, INC. IS NOT RESPONSIBLE FOR THE CONTENTS OF ANY LINKED SITE
OR ANY LINK CONTAINED IN A LINKED SITE, OR ANY CHANGES OR UPDATES TO SUCH
SITES.
MBD INVESTMENT GROUP, INC. IS PROVIDING THESE LINKS TO YOU ONLY AS A
CONVENIENCE, AND THE INCLUSION OF ANY LINK DOES NOT IMPLY ENDORSEMENT BY MBD
INVESTMENT GROUP, INC. OF THE SITE TO WHICH THE COMPANY WEB SITE LINKS, NOR SHALL
ANY LINK CREATE ANY EXPRESS OR IMPLIED WARRANTY BINDING ON MBD INVESTMENT
GROUP, INC. FURTHER, THE PRESENCE OF A LINK ON THE WEB SITE DOES NOT AND SHALL NOT BE DEEMED TO CREATE ANY AGENCY, PARTNERSHIP, JOINT VENTURE, PARENT, SUBSIDIARY, MEMBER, SHAREHOLDER, OR OTHER RELATIONSHIP OTHER THAN INDEPENDENT CONTRACTORS BETWEEN MBD INVESTMENT GROUP, INC. AND THE OWNER OR OPERATOR OF ANY THIRD-PARTY WEB PAGE OR SITE TO WHICH THE WEB SITE LINKS. IF YOU HAVE ANY CLAIMS AGAINST THE OPERATOR OF ANY THIRD-PARTY WEB PAGE OR SITE, YOU AGREE THAT YOU WILL PURSUE SUCH CLAIMS AGAINST THAT THIRD PARTY AND WILL HOLD MBD INVESTMENT GROUP, INC. HARMLESS FROM ANY LIABILITY RELATED TO SUCH CLAIMS.
This Agreement comprises the entire agreement between you (the Visitor) and MBD INVESTMENT GROUP, INC., and supersedes any prior or previous agreements between you and MBD INVESTMENT GROUP, INC. with respect to the subject matter of this Agreement; provided, however, that you agree that you shall be subject to any revised or additional terms and conditions of which MBD INVESTMENT GROUP, INC. notifies you from time to time, pursuant to this Agreement. You agree that your continuing use of MBD INVESTMENT GROUP, INC.'s services after MBD INVESTMENT GROUP, INC. notifies you of such revised or additional terms and conditions shall be deemed your assent to all of the revised or additional terms and conditions. If you have not registered at the WEB SITE, then you agree that the posting of such revised or additional terms and conditions shall constitute sufficient notice to you of such revisions or additions.
Any failure by MBD INVESTMENT GROUP, INC. to enforce this Agreement in every instance in which it might have application does not amount to a waiver of any of MBD INVESTMENT GROUP, INC.'s rights.
This Agreement may not be modified orally.
Subject to the Privacy Policy for www.gratefulgrebe.com, MBD INVESTMENT GROUP, INC. shall have the right to assign or transfer any or all of its rights and obligations under this Agreement without your consent. You may not assign or transfer any of your obligations under this Agreement without the prior written consent of MBD INVESTMENT GROUP, INC.
ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT OR
ANY BREACH THEREOF SHALL BE SETTLED BY ARBITRATION IN ACCORDANCE WITH THE
COMMERCIAL ARBITRATION RULES OF THE AMERICAN ARBITRATION ASSOCIATION, AND
JUDGMENT UPON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT
OF COMPETENT JURISDICTION.
